McKee indeed lost the lawsuit brought by Fry for patent infringement concerning the manufacture of lead glass pressed blanks for cutting but then they entered into an agreement to licence the patent and continued making the pressed blanks. In 1913, McKee got around the agreement and the patent completely by making lime glass pressed blanks.
